GENERAL NOTE:
Transfer of Ownership of Downloaded Digital Computer Files (MP3s): Inquiries have shown that many countries expressly forbid the resale (transfer of ownership) of any downloaded digital computer files (e.g. MP3s), as these are sold to an individual on a single user license basis. And, as in the case of digital media, no such “transfer” (and subsequent deletion by the vendor) is verifiable. To be certain of the circumstances in the area where you live, local information on licensing must be obtained. In the absence of accurate legal information, we recommend that you do not transfer computer files.
1. Can I make a backup copy of purchased music?
Yes (subject to local licensing laws), provided that you retain ownership of the original.

2. Can I place copies of purchased music on my laptop?
Yes (subject to local licensing laws), provided that you retain ownership of the original.

3. Is it OK to purchase a CD and copy (rip) the music onto my computer?
Yes (subject to local licensing laws), provided that you retain ownership of the original.

4. Can I digitize my copy of a 45 RPM record?
 Yes (subject to local licensing laws), provided that you retain ownership of the original.

5. Can I edit purchased music, perhaps to lengthen it, or change its pitch or tempo?

Yes (subject to local licensing laws), provided that you retain ownership of the original.

​6. Can I make a copy of purchased music, and sell the copy?
No. You can only sell the original purchased copy. Digital copies of any kind cannot be retained.

7. Can I make a copy of purchased music and give away the copy?
No. You can only give away the original purchased copy. Digital copies of any kind cannot be retained.

8. Can I make a copy of purchased music and loan the copy so a friend can "evaluate" the music?   He/she will purchase a copy if they like it, and they won't use it if they don't like it.
 No. With digital media no such “evaluation” (and subsequent deletion if not purchased) is verifiable.

9. I purchased a song that I no longer want or use.  Can I sell it or give it away?
 Yes, you can sell or give way the original, but if you do you must not retain a digital copy in any form.
10. I purchased a retired caller's equipment and it came with a laptop full of music.  Can I use this music?
No, not if the “Transfer of Ownership of Downloaded Digital Computer Files” (shown above) applies.

11. I own a record and want a digital version of it.  Can a friend of mine who has already digitized this record, or who purchased the MP3 version of the music give (or sell) me a copy?
No, not if the “Transfer of Ownership of Downloaded Digital Computer Files” (shown above) applies.

12. I own a record which is no longer usable (very scratched or warped).  Can a friend of mine give me a digital copy?
No, not if the “Transfer of Ownership of Downloaded Digital Computer Files” (shown above) applies.

13. I purchased music.  Can I play that music at a square dance?
Yes, BUT only if you have bought a licence (applicable in the area where you are working) that will permit its use.  Every country seems to have this type of license available, but you will need to inquire.

14. What if the square dance is not for profit?
You still need a performance license.  The issue is "public" performance. Non-public is "a limited circle of family and friends".

15. A certain record is out of print and the company that made it is no longer in business.  Can someone who has a copy, make a copy and give it to me?
No. The copyright still belongs to somebody and the owner of that copyright would have to provide their specific permission to allow this to happen. PLEASE NOTE: The CALLERLAB Record Producers Committee has located the owners of the vast majority of records in this category. If you contact them, they can pass on your inquiry.  However, it should also be noted that some “out-of-print” records are intended to be “unavailable” for a reason (e.g. they may have been subject to a “limited release”).  Our hope is that the CALLERLAB Record Producers Committee will soon be able to remove this situation in general, and help to make the majority of “out-of-print” records available.
16. I own a record and I also bought the MP3 version of it.  Am I allowed to sell or give away the record?
Yes, you can sell the original, BUT only if you purchased the MP3 from a licensed distributor.
